Punjab & Haryana High Court Quashes Rape FIR Against Man Who Was Not in India
The Punjab and Haryana High Court has quashed an FIR filed against a man accused of gang rape after confirming that he was not in India at the time of the alleged incident.
Court Calls the Case a Misuse of Law
A bench led by Justice Jagmohan Bansal reviewed evidence presented by the Investigating Officer, which proved that the accused was in London on the date the crime was said to have occurred. The court criticized the misuse of legal processes and labeled the case an example of blackmail.
“This type of allegation must be discouraged because it makes it difficult for courts to distinguish genuine cases from false ones,” the bench noted.
Evidence Proved Accused Was Abroad
The accused presented official travel records showing that he had left India on January 26, 2019. The alleged incident occurred on the night of February 1-2, 2019, making it impossible for him to have committed the crime.
Further, the prosecutrix had already turned hostile regarding three other accused persons, further raising doubts about the allegations.
“It is unfortunate that a woman has accused a man of rape when he was not even in India at the time,” the court observed.
FIR Quashed, Court Raises Concern Over False Allegations
Considering the strong evidence, the court quashed the FIR, emphasizing the seriousness of false allegations in legal proceedings.
This judgment highlights the importance of thorough investigations before filing charges and the need to prevent misuse of the legal system.
