Punjab & Haryana High Court Clears Man of Rape Charge Due to Foreign Travel Alibi

Last week, the Punjab and Haryana High Court took action to quash an FIR lodged against a man accused of gang rape, after establishing that he was out of the country at the time of the alleged offense.

Justice Jagmohan Bansal, presiding over the case, termed the accusation a case of blackmail and misuse of legal procedures. The court emphasized the difficulty in distinguishing genuine cases from those with malicious intent.

According to court records, the accused presented evidence confirming his presence in London during the period when the alleged rape occurred in India. The court observed that the complainant’s inconsistent statements further undermined the case’s credibility.

“The petitioner was documented to have left India on January 26, 2019, well before the alleged incident on February 1/2, 2019. It is regrettable that such serious allegations were leveled against a man who was indisputably abroad,” remarked the court.

Consequently, the court ruled to quash the FIR, underscoring the importance of factual accuracy in criminal proceedings.
