In a unique ruling, the Pune family court has ordered a 78-year-old woman to pay Rs 25,000 per month as interim alimony to her 83-year-old husband. The judgment was delivered by Family Court Judge Raghavendra Aradhye.
The elderly couple, married for 55 years, filed for divorce in 2019. The husband, an 83-year-old director of an educational institution, accused his wife, the president of the same organization, of harassment. They got married in 1964, and according to the husband’s claims, his wife has been pressuring him to leave the institution and their home.
The husband also stated that he took care of his wife during her illness, but she started harassing him again once she recovered. He suffers from diabetes and heart disease, and his doctor has advised him to maintain a healthy diet and take his medications regularly. However, he alleges that his wife has prohibited him from eating at home, which led him to file for divorce in 2018 due to constant harassment.
Both parties have accused each other of having extramarital affairs. The couple has two married daughters.
Advocate Vaishali Chandne, representing the husband, explained, “If the husband does not have an income source and the wife does, he can claim alimony under Section 24 of the Hindu Marriage Act, 1955. This case shows that not only women but also men facing injustice can receive justice.”
On Friday, the court ruled in favor of the husband, ordering the wife to pay him Rs 25,000 per month as alimony.
