Supreme Court Grants Protection to Man Accused of Rape by Ex-Wife

The Supreme Court has granted protection to Paras, a 29-year-old man accused of rape and blackmail by his ex-wife. Paras, who converted to Islam to marry a Muslim woman in April 2019, faced serious allegations after their divorce in July 2019.

The couple, seeking protection from threats posed by the woman’s parents, initially received protection from the Rajasthan High Court in May 2019. However, their relationship soured, and in April 2023, the woman filed an FIR accusing Paras of attempting to force her into prostitution, raping her, and blackmailing her with explicit photos.

Paras sought relief through various courts and eventually found success in the Supreme Court, which ordered that he should not be arrested at this time. The Court also issued a notice regarding his plea for anticipatory bail.

Paras’s lawyer argued that the four-year delay in lodging the FIR and the content of the complaint suggested ulterior motives. The lawyer pointed out that during the period of the alleged incidents, the woman had sought protection from her own family through the Rajasthan High Court.

The plea noted that the FIR was filed to harass and extort money from Paras, who had married his ex-wife despite being aware of her involvement in sex work. It was also mentioned that she continued her lifestyle after marriage, leading to their separation.

Paras claimed that the allegations were false and aimed at making him appear guilty to extort money. The plea argued that the High Court failed to recognize that the FIR’s accusations did not meet the necessary legal criteria to implicate him. Additionally, no witnesses or evidence supported the claims made in the FIR.

The Supreme Court’s decision to protect Paras underscores the complexities of the case, highlighting the significant delay in filing the FIR and potential ulterior motives.
