Piercing Girl Child’s Ears Is Not Child Abuse: Delhi HC Orders Removal of Defamatory Content
The Delhi High Court recently issued an interim order directing Mint newspaper to remove a defamatory article against popular YouTuber Gaurav Taneja and his wife, Ritu Rathee. The article accused them of child abuse for piercing their elder daughter’s ears, sparking widespread controversy.
Case Background
The article, published on May 8, alleged that Taneja and Rathee committed child abuse by sharing a video of the ear-piercing procedure on social media. It described scenes of their daughter crying in pain while being filmed. These allegations were strongly contested by Taneja and Rathee, leading to a legal battle.
Court Observations
Justice noted that piercing a girl child’s ears cannot be categorized as child abuse. “Serious allegations like child abuse must be made with proper care and verification and cannot be based solely on personal opinions,” the Court stated.
The Court also directed journalist Abhishek Baxi to delete a related tweet and refrain from sharing similar defamatory content online or offline. While acknowledging the right to free speech, the Court emphasized that such freedom does not justify attacks on an individual’s character under the guise of journalism.
Defamation Case
Taneja and Rathee had previously filed a defamation suit in a lower court, which was rejected in June. Upon approaching the High Court, they argued that the article and related tweets damaged their reputation, leading to significant harm, including loss of sponsorships.
The Court found that the couple had made a strong case, and without intervention, they would continue to suffer irreparable harm. “The balance of convenience lies in favor of the plaintiffs,” the Court noted.

The High Court directed Mint and its journalist to remove the article and tweets immediately, citing the potential damage to the plaintiffs’ careers and reputation.
