Noida Custody Death: Youth Accused of Rape Found Dead, Police Officers Suspended
In a shocking case from Noida, a 20-year-old man taken into police custody over a rape allegation was found dead at the Chipyana police post on May 16. His death has sparked serious allegations against the police, including bribery and unlawful detention.
The deceased, identified as Yogesh Kumar, worked at a bakery in the village and also lived on the premises. His family claims that the police demanded a bribe for his release and refused to let them see him before his tragic death.
Arrest Without an FIR
A complaint had been forwarded to the assistant commissioner of police from the director general of police (Lucknow), accusing Yogesh of rape and sexual harassment at his workplace. The alleged incident took place about one and a half months ago, but notably, no FIR was registered before the police took him into custody.
Police questioned him on May 15, and by 10 AM the next day, he was found hanging from a rope inside the police barracks. Officers rushed him to a nearby hospital, where doctors declared him dead on arrival. The National Human Rights Commission (NHRC) guidelines are now being followed in the investigation.
Bribery Allegations by the Family
Yogesh’s brother, Jitendra, has made serious accusations against the police. He claims that officers demanded ₹5 lakh to release Yogesh. When Jitendra could only pay ₹53,000, the police allegedly told him to bring the remaining amount the next day. However, the next morning, he was denied access to his brother, only to be informed later that Yogesh had died in custody.
Jitendra also mentioned that the accuser had a personal dispute with Yogesh two months ago, which had been resolved by their manager. However, she allegedly threatened him later, saying she would ensure he was jailed.
Police Action and Investigation
Following the incident, Noida Police Commissioner Laxmi Singh announced the suspension of all officers posted at the Chipyana police post, except for two under-training personnel. A preliminary investigation has been launched against:
- The police post in-charge
- Bisrakh police station in-charge
- The assistant commissioner of police
Additional DCP of Noida, Manish Mishra, has been directed to conduct a thorough inquiry. A post-mortem examination will be conducted by a panel of doctors, with videography to ensure transparency.
Regarding the bribery allegations, Singh clarified that the family’s written complaint only named the woman accuser and not the police. However, she assured that the bribery claims would also be investigated.
Legal Action Against the Accuser
After the family’s complaint, an FIR was registered against the woman who accused Yogesh of rape. She has been charged under Section 306 (abetment to suicide) of the Indian Penal Code (IPC) at the Bisrakh police station.
Human Rights Violation?
RTI and human rights activist Rajeev Kumar Sharma condemned the incident, stating that it was unlawful for the police to detain Yogesh without an FIR. The case has raised concerns about police brutality, custodial deaths, and corruption within law enforcement.
