In a recent matrimonial dispute hearing, Chief Justice of India, DY Chandrachud, gave important advice to a couple locked in a legal battle. The Chief Justice recommended that the couple consider opting for a divorce by mutual consent rather than engaging in a prolonged legal fight. According to him, only the lawyers would benefit from a long, drawn-out court case.
During the hearing, the Chief Justice asked the woman about her educational background. She responded that she holds an MTech degree and a doctorate from a US university but was currently not employed. In response, the Chief Justice said, “You are so educated and do not have a job. You must find a job for yourself.”
The Chief Justice urged the couple to be practical about the situation. He highlighted that spending years fighting the case would waste their time and resources. “You can spend 10 years of life fighting this case, and only lawyers will gain from it. Why not agree to divorce by mutual consent and move forward with your lives?” he suggested. He also mentioned that if they opted for mutual consent, they could avoid further complications like criminal complaints.
Given the woman’s educational qualifications, Chief Justice Chandrachud emphasized that she should focus on her career, stating, “It is clear you cannot go back to each other. Now, if you were uneducated, it might be different. But you are highly qualified, and you can get a job.”
The Chief Justice’s remarks underline the importance of mutual consent divorces in reducing the emotional and financial strain on individuals. His advice also stressed the need for educated women to pursue careers and maintain financial independence, even during personal struggles.
