Mumbai Police Commissioner Says No Molestation or POCSO FIR Without DCP Approval
Mumbai Police Commissioner Sanjay Pandey has ordered that FIRs for molestation and crimes under the POCSO Act can only be registered after the recommendation of the Assistant Commissioner of Police (ACP) and with the permission of the zonal Deputy Commissioner of Police (DCP).
This order came after the Commissioner noticed many false cases being filed due to personal conflicts, money issues, or other reasons.
The Commissioner’s order, released on Monday, said that in many cases, accused persons are arrested quickly before checking facts. Later, these complaints turn out to be false.
This harms the accused’s reputation even if they are later cleared.
To prevent this, police officers have been told to register FIRs for molestation or POCSO-related crimes only after they get approval from the divisional ACP and zonal DCP.
The order also said that when giving permission, the DCP should follow the guidelines from the 2013 Supreme Court judgment in the “Lalita Kumari vs Govt. of UP and others” case, which sets rules on FIR registration.
