The Madhya Pradesh High Court, comprising Justice Rohit Arya and Justice Milind Ramesh Phadke, emphasized that a husband and wife are expected to live together with a sense of adjustment. This observation was made while hearing an appeal by a wife against a decree for Restitution of Conjugal Rights (RCR) granted to her husband.
The couple married in April 2015, but they started living apart just a few days later, in May 2015. In May 2018, the husband filed a petition under Section 9 of the Hindu Marriage Act, 1955, seeking the restoration of their marital life. The Court of First Additional District Judge in Dabra, Gwalior, awarded the decree in his favor, recognizing his genuine intentions.
The wife appealed this decision in the High Court. However, during the hearing, she expressed her willingness to live with her husband and decided not to pursue the appeal further. The husband assured the court that he would provide a dignified and respectful life for her, within his means, if she returned to live with him.
The court appreciated the husband’s positive gesture towards his wife and upheld the previous order and decree issued by the First Additional District Judge, Dabra, District Gwalior.
