Further, the husband accused his wife of engaging in vulgar chats with her former lovers via WhatsApp. He presented printouts of these conversations in court. In response, the wife denied any inappropriate relationship and claimed that her husband had hacked her phone and manipulated messages to frame her. She also accused him of physically assaulting her and demanding a dowry of ₹25 lakh.

Court Observations

The court noted that the woman’s father, a seasoned lawyer, admitted that his daughter often chatted with male friends. Despite serious allegations, there were no counter-complaints or FIRs filed by the woman against her husband for domestic violence or privacy violations.

The court emphasized that married individuals must maintain dignity in their interactions, especially with the opposite gender. “No husband would tolerate vulgar chats by his wife with other men. Such behavior constitutes mental cruelty,” the court remarked.

Final Verdict

The court concluded that the husband had provided sufficient evidence of mental cruelty. It affirmed the family court’s decision, stating, “The respondent has certainly made out the case by way of evidence that the appellant committed mental cruelty upon him.”

Thus, the woman’s appeal was dismissed, confirming the divorce.
