Madhya Pradesh High Court Denies Bail to Disabled Man Accused of Refusing Marriage Due to Caste Differences
The Madhya Pradesh High Court recently denied bail to a disabled man accused of rape under the pretext of marriage. The refusal to marry was based on caste differences.
Justice Vivek Agarwal was informed that the father of the accused did not allow the marriage because of a five-year age difference and the survivor being from a different caste.
The court stated, “In the 21st century, it’s shocking that social differentiation based on caste and creed still exists.”
This was the second bail application by the accused in the rape case. He argued that the survivor consented to sexual intercourse and they had stayed together at hotels multiple times.
The prosecution, however, argued that this was not a simple case of consensual pre-marital sex. Both the accused and the survivor are disabled, and the accused had promised marriage to the survivor. After securing a job with the Defence Ministry, the accused refused to marry her.
The court noted that the accused was aware of the age and caste differences from the beginning. Considering the survivor as a vulnerable witness, the court denied bail.
“I believe that in the interest of justice and to protect a vulnerable witness, this is not the right time to grant bail to the applicant,” the court stated.
