Madhya Pradesh Court Orders Woman to Pay ₹5,000 Monthly Maintenance to Husband

A family court in Indore, Madhya Pradesh, has ordered a woman to pay ₹5,000 in monthly maintenance to her husband after their separation. The court’s decision comes after Aman Kumar, a Class XII pass out, claimed his wife Nandini, who runs a beauty parlour, caused him significant hardship.

According to Aman’s lawyer, Manish Zarole, Aman and Nandini met through a mutual friend in 2020. Nandini proposed marriage, and despite Aman’s reluctance, she threatened self-harm if he refused. The couple married in July 2021 at an Arya Samaj Mandir and settled in Indore.

Aman alleged that soon after the marriage, Nandini and her family began to harass him, leading him to drop out of college and leave their home in September 2021. They have been living separately since then.

The court agreed with Aman’s claim that he had to leave college at his wife’s insistence and was now unemployed, while Nandini, a graduate, operated a beauty parlour in Indore. Aman also claimed that Nandini filed a missing person report when he left and later accused him of harassment and filed for domestic violence.

In response, Aman petitioned the Indore court to annul the marriage and seek maintenance. Nandini, who had earlier requested to live with Aman and save their marriage, was found to have provided contradictory statements during the hearing. The court rejected her plea and ordered her to pay ₹5,000 monthly maintenance, along with additional litigation expenses.

Nandini stated her intention to challenge the order in a higher court and promised to reveal more details then. Under the Hindu Marriage Act, 1955, both men and women are eligible to claim maintenance.

The case also highlights ongoing discussions about uniform maintenance and alimony provisions, as a public interest litigation was filed in the Supreme Court in 2020 seeking a gender-neutral approach to these issues.
