Minor Disputes Between Husband and Wife Not Cruelty, Says Madhya Pradesh High Court

The Madhya Pradesh High Court has said that small disagreements between a husband and wife cannot be called cruelty. The court cancelled a family court’s divorce order that had been granted to a husband.

A bench of Justices Vivek Rusia and Amar Nath was hearing a case where a wife had challenged a divorce granted in favor of her husband. The husband had claimed that his wife had lied about her age and education on a matrimonial website. He also alleged that she was arrogant, suffered from bad body odor, refused treatment, and could not ride a two-wheeler as claimed in her profile.

He further claimed that she did not want to care for his elderly parents and threatened to file false cases against his family.

However, the wife said she wanted to live with her husband and make the marriage work.

The court noted that it was an arranged marriage, fixed after proper meetings between the families. They got married on May 31, 2010, but the husband left her within five months, on October 25, 2010.

The judges said, “A husband cannot ruin his wife’s life for no valid reason. Minor fights cannot be called cruelty. A marriage needs time, and both partners must adjust and understand each other gradually.”

The bench also observed that the husband had not made any effort to bring his wife back, and all the issues happened within the first year of marriage. He never gave her a second chance and even refused to accept her in court, while she was ready to live with him again.

The court also added that under the Hindu Marriage Act, a husband cannot get a divorce without proper legal reasons. The bench then cancelled the earlier divorce order and ruled in the wife’s favor.

Lastly, the court directed the husband to pay ₹8,000 per month to his wife as interim maintenance until the couple resumes their married life.
