Chhattisgarh High Court: Wife’s Allegations of Husband’s Illicit Relationship with His Mother is Mental Cruelty

In a significant ruling, the Chhattisgarh High Court has declared that a wife’s repeated allegations accusing her husband of having an illicit relationship with his own mother amount to mental cruelty and an attack on the sacred bond between mother and son.

The bench, consisting of Justice Goutam Bhaduri and Justice Sanjay S. Agrawal, upheld the appeal filed by the husband, overturning the family court’s previous decision to deny him a divorce.

The case involved a couple who were married in May 2011. According to the husband, his wife’s behavior became hostile after their marriage, as she frequently verbally abused both him and his mother. Frustrated by her conduct, the husband sought a divorce from the family court, but his request was initially rejected.

Upon reviewing the evidence, the High Court found that the wife had deserted her husband in December 2013 and had filed a false complaint against him and his relatives under Section 498-A of the Indian Penal Code. However, due to a lack of evidence, all the accused were acquitted. Moreover, the wife admitted in court that she had falsely accused her husband of maintaining an illicit relationship with his mother.

Taking into account the mental cruelty inflicted by such accusations, the court ruled in favor of granting the husband a divorce. At the same time, recognizing the wife’s right to maintenance, the court ordered that a monthly sum of ₹35,000 be deducted directly from the husband’s salary as maintenance for the wife.
