Men Deserve Equal Protection From Violence: Delhi High Court Denies Bail to Woman Accused of Attacking Husband
The Delhi High Court recently pointed out that men, just like women, also face violence and cruelty in marriages and deserve equal protection under the law.
Justice Swarana Kanta Sharma observed that it is wrong to believe that only women suffer in marriages. Men, too, can be victims and must be given the same legal safeguards.
The Court made these comments while hearing a woman’s request for anticipatory bail. She was accused of seriously injuring her husband by pouring boiling water mixed with chilli powder on him.
The woman argued that she deserved leniency because she is a woman. However, the Court rejected this claim, saying that decisions must be free from gender bias.
The judge emphasized that protecting one gender should not come at the cost of fairness to another. Crimes that cause serious injuries must be treated equally, whether committed by a man or a woman.
Justice Sharma highlighted that men can also face unique challenges when they are victims in marriages. In this case, the husband had filed a police complaint before the incident. He alleged that he was forced into marriage under the threat of a false rape case and later discovered that his wife had previously married multiple men and filed cases against them too.
The tragic event happened on January 1, when the woman allegedly poured hot water over her sleeping husband, injuring his eyes, chest, and neck. After attacking him, she reportedly locked the room from outside, took his phone to prevent him from seeking help, and fled, leaving behind their three-month-old daughter.
The woman tried to argue that the attack happened after a fight involving the husband talking to other women. However, the Court found no explanation for the serious injuries or why she locked him in and escaped with his phone.
The Court firmly rejected her bail plea, noting that the pain and trauma caused by violence are the same for men and women. It said it would be unfair if women committing such crimes were treated more leniently just because of their gender.
Additionally, the Court dismissed the argument that she should be granted bail because she has a young child. It highlighted that she had abandoned the child with the injured husband when she fled.
Given the serious nature of the allegations, the injuries, and the fact that the woman failed to cooperate with the investigation, the Court ruled that she did not deserve pre-arrest bail.
