A division bench of Justice Alok Aradhe and Justice Anant Ramanath Hegde reviewed the appeal filed by the husband, overturning the family court’s decision which had previously denied the divorce decree.
Marriage Background
The couple married in 2007 and had a daughter. In 2012, the husband sought a divorce from a family court in Bengaluru, alleging that his wife frequently humiliated him due to his dark skin. Additionally, in 2011, the wife filed a false complaint against him and his family under Section 498A of the Indian Penal Code, leading her to move back with her parents.
Court’s Observations
The wife denied the husband’s allegations and claimed he had an illicit relationship with another woman, accusing him of assault and mistreatment by his family. However, the court found no substantial evidence supporting the wife’s claims of the husband’s illicit relationship or the birth of a child from such a relationship.
The court noted that the family court failed to consider the impact of the wife’s baseless and reckless allegations on the husband’s character. During cross-examination, the wife expressed willingness to rejoin her husband but refused to withdraw her complaints, indicating a significant rift between them.
Conclusion
The court concluded that the wife’s actions amounted to cruelty and upheld the husband’s petition for divorce. The court emphasized that the wife’s unwillingness to withdraw her false complaints, even if she rejoined her husband, supported the husband’s claims of ill-treatment.
