Kerala is set to become the first state in India to make divorce registration mandatory. The state government is working on a new law to ensure the welfare of divorcees and their children by requiring all divorces to be officially registered in a dedicated registry.
The decision follows recommendations from the Kerala Legislative Assembly Committee on the Welfare of Women, Transgenders, Children, and Differently Abled. Local Self-Government Minister M.V. Govindan confirmed that the legislation aims to protect the rights and futures of children involved in divorce cases.
The proposed divorce registry will include details about children, if any, at the time of the divorce. This initiative aligns with a 2008 Law Commission of India report, which recommended mandatory registration for both marriages and divorces to improve legal clarity and ensure accountability.
Minister Govindan emphasized that Kerala is leading by example, as no other Indian state currently requires divorce registration. Since marriage and divorce fall under the concurrent list in the Constitution, Kerala has the authority to legislate on this matter.
The new law will be enacted as part of the Kerala Marriage and Divorce Registration Act. The existing Kerala Marriage Registration Rules, 2008, will be amended to include provisions for registering divorces.
