A man from Surat, Gujarat, has been ordered by the Gujarat High Court to pay ₹2 lakh per month as maintenance to his wife and two children, after failing to pay the previously ordered ₹12,000 per month since 2017.
The case began in March 2017, when the wife approached the family court, claiming that her husband had deserted her a year earlier. She demanded ₹3 lakh per month for herself and ₹1 lakh for each of the two children. She also claimed that her husband was in the diamond business, owned a factory, and earned ₹25 lakh per month.
However, the husband denied these claims, saying he was only doing job work in diamonds and didn’t earn that much. He also told the court he wanted his wife back and had filed a case for restitution of conjugal rights.
In November 2019, due to the lack of income proof, the family court estimated his monthly income between ₹40,000–₹50,000 and ordered him to pay ₹6,000 to his wife and ₹3,000 to each child. But he allegedly never paid this amount.
The wife then approached the High Court asking to increase the maintenance. In February 2021, the High Court ordered the man to pay ₹3.25 lakh as he had not made any payments till then.
Later, in September 2023, the wife’s lawyer informed the court that the man continued to ignore the orders and even avoided appearing in court. The court was also told that he was using his influence to escape warrants.
Hearing this, Justice Samir Dave strongly criticized the man’s actions, saying: “This is not done.” The court then raised the monthly maintenance from ₹12,000 to ₹2 lakh, and increased the arrears from ₹7.92 lakh to ₹1.32 crore, calculated from March 2017.
