The Bombay High Court recently ordered the release of a man named Pratap Jivani, who was forcibly admitted to a rehabilitation centre by his wife. The Court found no medical evidence to support his stay at the centre.
A writ petition was filed by Jayendra Narandas Bhatia, Pratap’s cousin, after Pratap’s real brother informed him that Pratap needed urgent hernia surgery but was being held in a rehab centre.
A division bench of Justice Revati Mohite Dere and Justice Gauri Godse heard the case. They noted, “There are no medical papers to show Pratap needed to be in a rehabilitation centre. So, we allow him to leave with the petitioner.”
According to the petitioner, Pratap’s wife admitted him to the Amulya Prem Foundation in Bhiwandi for psychiatric treatment, claiming he had tobacco addiction. However, the petitioner said Pratap was being held illegally without medical reasons.
Following a court order, Pratap was brought to court along with the centre’s representatives. During the hearing, Pratap stated that he was in the centre because of his wife’s instructions and he wanted to leave with his cousin. A representative of the centre confirmed they admitted and detained him based solely on the wife’s instructions.
The court concluded that Pratap’s detention was not supported by any medical documents, and that it was only due to his wife’s request, which made the detention illegal.
As a result, the Court allowed Pratap to leave with the petitioner and closed the case.
