A Delhi court has acquitted a man who was falsely accused of sexually assaulting minor girls, ordering the state to pay him 1 lakh as compensation. The court found that the children were coached by their parents, who held a grudge against the man due to a dispute over their dogs defecating in front of his house.
District and Sessions Judge Dharmesh Sharma stated there was ample evidence proving the man was framed due to caste hatred. The accused belongs to the Dalit community, and the judge noted that false accusations often arise from such prejudices.
“It is our experience in the criminal justice system that people level false accusations for various reasons, one of which is caste hatred, as seen in this case,” Judge Sharma said in his judgment dated August 7.
The case was filed against the man in 2015 under the Protection of Children from Sexual Offences (POCSO) Act for allegedly assaulting his neighbor’s minor daughters. He was arrested and had been in jail since then.
The accused informed the court that the parents of the girls had a longstanding grudge against him due to disputes over their dogs defecating near his house, leading to frequent arguments.
Judge Sharma concluded that the case appeared to be the result of the children being heavily coached to make false allegations of repeated sexual assault at their parents’ behest. He described the act as “sinister” and done in a “shameless manner.”
The court ordered the state to pay the man 1 lakh as compensation within two months, calling it a “symbolic amount.” The judge criticized the investigation, noting that the statements of the victim girls were not recorded by a female police officer as required, and the investigating officer failed to conduct a fair investigation.
“In our society, there is a constant fight between the ‘good’ and the ‘evil,’ and we are living in an age where moral values are degenerating, and everything is possible,” Judge Sharma remarked.
