Man Ignores Rs 12,000 Maintenance Order, Now Must Pay Rs 2 Lakh Per Month

A man from Surat ignored a court order to pay Rs 12,000 per month as maintenance to his wife and two children. Now, the Gujarat High Court has increased the amount to Rs 2 lakh per month because he failed to follow the earlier order.

In 2017, the wife filed a petition in the family court asking for maintenance. She said her husband had left her a year earlier and was earning Rs 25 lakh per month through his diamond business. She asked for Rs 3 lakh for herself and Rs 1 lakh for each of her two children every month.

The husband denied her claims and said he only did diamond job work and didn’t earn that much. He also said he wanted to live with his wife again and had filed for the restitution of conjugal rights.

In 2019, the family court set the maintenance amount based on an estimated income of Rs 40,000 to Rs 50,000 per month. It ordered him to pay Rs 6,000 to his wife and Rs 3,000 each to his children. However, the man did not pay the amount as directed.

The wife then went to the High Court, asking for an increase in the maintenance. Meanwhile, the husband challenged the original order. In February 2021, the High Court ordered the man to pay Rs 3.25 lakh, as he hadn’t paid anything to his wife and children.

By September 2023, the wife’s lawyer, Rajendra Jadhav, told the court that the husband had still not paid any amount and had ignored the court’s previous directions. He said the man was powerful enough to avoid court actions like warrants.

Justice Samir Dave responded strongly to this behavior. He increased the monthly maintenance to Rs 2 lakh and said the unpaid amount from March 2017 had now grown from Rs 7.92 lakh to Rs 1.32 crore.
