Madhya Pradesh High Court Modifies Controversial Rape Conviction Judgment
Last week, the Madhya Pradesh High Court revised a controversial judgment that stated a rape convict was “kind enough” to leave the survivor alive. The original judgment, issued on October 18, reduced the convict’s life sentence to 20 years in prison.
A bench of Justices Subodh Abhyankar and Satyendra Kumar Singh made this observation, which sparked widespread outrage. In response to the backlash, the court decided on October 27 to amend the order and remove the controversial remark about the convict’s “kindness.”
The court stated, “It is brought to the notice of this court that certain inadvertent mistakes have crept into the judgment delivered on 18.10.2022, where the word ‘Kind’ was used to refer to the appellant who stands convicted of rape…It is apparent that this mistake is inadvertent, as this court has already described the appellant’s actions as demonic.”
The modified sentence now reads: “However, considering the fact that he did not cause any other physical injury to the victim, this court is of the opinion that the life imprisonment can be reduced to 20 years’ rigorous imprisonment.”
The court ordered that the judgment dated October 18, 2022, be read in conjunction with the revised order, retaining the reduction in sentence but omitting the term “kind.”
The original judgment was in response to an appeal by Ramsingh, who had been convicted by the Additional Sessions Judge, Indore, for raping a girl under twelve years of age. The High Court’s decision was based on the prosecution witnesses’ evidence and the medical report, which conclusively proved the appellant’s guilt.
However, the court reduced the sentence from life imprisonment to 20 years, noting that the appellant had not killed the victim.
