The Madhya Pradesh High Court recently refused bail to a differently-abled man accused of rape under the pretext of marriage. The case brought to light caste-based discrimination and highlighted social issues still prevalent in modern India.
Justice Vivek Agarwal presided over the case, where it was revealed that the accused’s father objected to the marriage due to a five-year age gap and the survivor’s caste. The court expressed disappointment that caste and social differences continue to play a divisive role in society.
“In the 21st century, it is disheartening to see social differentiation being created based on caste and creed,” the court remarked.
The accused sought bail for the second time, arguing that the relationship was consensual and that the couple had stayed in hotels on multiple occasions. However, the prosecution contended that the accused had misled the survivor by promising marriage.
The court noted that the accused was aware of both the age and caste differences but still pursued the relationship. When he secured a job with the Defence Ministry, he refused to fulfill his promise to marry the survivor.
Considering the survivor as a vulnerable witness, the court determined that granting bail at this stage could undermine justice.
“I believe that to safeguard the interests of justice and protect the vulnerable witness, granting bail at this stage would be inappropriate,” Justice Agarwal concluded.
The case underscores the importance of addressing caste-based prejudices and protecting vulnerable individuals within the justice system.
