The Madhya Pradesh High Court recently revised its judgment in a controversial rape case where it had previously stated that the convict was “kind enough” to leave the survivor alive. Following widespread criticism, the court removed this remark.

Court’s Modification

A bench of Justices Subodh Abhyankar and Satyendra Kumar Singh had, on October 18, reduced a rape convict’s life sentence to 20 years in prison. The decision sparked outrage due to the court’s wording. In response, the court, on October 27, decided to amend its order, stating that the use of the term “kind” was an inadvertent mistake.

Official Clarification

The court acknowledged the error, emphasizing that the convict’s actions were demonic and that the previous remark was not appropriate. It modified the sentence to state that since the convict did not inflict additional physical injuries on the victim, the life sentence would be reduced to 20 years of rigorous imprisonment.

Background of the Case

The judgment pertained to an appeal by Ramsingh against a ruling by the Additional Sessions Judge in Indore, which had convicted him for raping a girl under twelve years old under the Indian Penal Code. The High Court relied on prosecution witnesses and medical evidence to establish guilt beyond reasonable doubt.

Conclusion

While the sentence reduction remained unchanged, the court ensured that its wording accurately reflected the gravity of the crime. This modification highlights the judiciary’s responsibility in handling sensitive legal language in sexual assault cases.
