Lawyer Loses District Judge Position Due to 498-A Case; Supreme Court Denies Relief

A lawyer who was disqualified from a District Judge role due to a 498-A case filed by his wife has been denied relief by the Supreme Court. Although he was acquitted of all charges, he could not regain his position.

In 2020, the Madhya Pradesh High Court advertised a District Judge position, open to eligible advocates. The lawyer applied, passed both the written and mains exams, and was selected under the Unreserved Category. He was informed by the Law Department to undergo a medical test.

However, on July 2, 2018, he was asked to submit a copy of FIR No. 852/2014, which he had previously disclosed in his application. On September 14, 2018, he was declared ineligible and removed from the candidate list.

The lawyer challenged this decision in the Madhya Pradesh High Court, but his petition was dismissed. He then appealed to the Supreme Court, which also rejected his case. Justices Ashok Bhushan and M.R. Shah concluded that the Exam-Selection Committee’s decision to disqualify him was correct. Despite his acquittal in the trial court, the pending criminal case at the time of selection was deemed sufficient reason for his disqualification.
