Gauhati High Court Convicts Lawyer for Disrespecting Woman Judge

The Gauhati High Court recently convicted a lawyer for making derogatory comments about a woman judge, including remarks on her jewelry and comparing her to the mythical character ‘Bhasmasur,’ a demon from Hindu mythology.

Court’s Verdict on Contempt of Court

A bench comprising Justice Kalyan Rai Surana and Justice Devashis Baruah took suo motu action against advocate Utpal Goswami, charging him with criminal contempt under Section 14 of the Contempt of Courts Act, 1971. The court granted him bail on a personal bond of Rs 10,000.

Lawyer’s Apology and Court’s Observation

The court stated that the lawyer made several derogatory remarks questioning the judge’s legal knowledge and personal appearance. He also accused her of trying to control the courtroom by frequently citing legal precedents. In his defense affidavit filed on January 17, the lawyer admitted his mistake, pleaded guilty, and apologized unconditionally. He assured the court that he would not repeat such behavior in the future.

Offensive Remarks Made by the Lawyer

The court order highlighted that the lawyer had insulted the judge by stating that she presided over the court while wearing jewelry “like a model on a ramp.” He also accused her of overpowering advocates by citing unnecessary case laws instead of listening to them. His comments were deemed highly disrespectful and amounted to contempt of court.

Legal Action Taken

The sentencing hearing was scheduled for March 20, 2023, but no further updates on the final decision have been received. This case underscores the importance of maintaining decorum and respect for the judiciary.
