Gauhati High Court Convicts Lawyer for Insulting Woman Judge
The Gauhati High Court has convicted advocate Utpal Goswami for making insulting and disrespectful remarks against a woman judge. He compared her to ‘Bhasmasur’, a mythical demon, and made inappropriate comments about her jewelry and conduct in court.
A division bench of Justice Kalyan Rai Surana and Justice Devashis Baruah took suo motu action and charged Goswami with criminal contempt under Section 14 of the Contempt of Courts Act, 1971. The court granted him bail on a personal bond of ₹10,000.
In its order, the bench noted that Goswami had made several disrespectful allegations against the judge, attacking her legal understanding and personal conduct. He accused her of acting like a model, wearing flashy jewellery in court, and overpowering advocates by quoting legal provisions unnecessarily.
The court observed:
“He portrayed the judicial officer in a derogatory way and even compared her to the mythological character Bhasmasur, known for destruction.”
In his defense, Goswami submitted an affidavit on January 17, where he admitted guilt and offered an unconditional apology. He stated that his actions were due to a lack of legal knowledge and promised never to repeat such behavior.
The court noted:
“He has realized the importance of respecting judges and maintaining peace and order in society. He assured the court that this was his first offense and would not be repeated.”
The sentencing hearing was scheduled for March 20, 2023, though no further update has been received.
This case highlights the importance of maintaining dignity and decorum in courtrooms, especially when addressing judicial officers.
