Kerala to Make Divorce Registration Mandatory
Kerala will soon be the first state in India to make divorce registration mandatory. This new law aims to ensure the welfare of divorcees and their children. The government plans to introduce legislation that will require divorces to be registered and create a comprehensive registry.
This decision follows recommendations from the assembly committee on the welfare of women, transgenders, children, and differently-abled individuals, according to Local Self Government Minister M V Govindan.
The divorce registry will include details about children, if any, at the time of divorce. This legislation aims to protect the future of children involved in divorces. The Law Commission of India, in its 2008 report, emphasized the need to register both marriages and divorces.
Minister Govindan noted that no other state in India requires compulsory divorce registration, making Kerala a pioneer in this area. Marriage and divorce are part of the concurrent list in the Constitution, giving the state the authority to legislate on divorce registration.
The new legislation will be enacted under the Kerala Marriage and Divorce Registration Act. The existing Kerala Marriage Registration Rules, 2008, will be amended to include provisions for divorce registration.
