Karnataka High Court Grants Divorce After Wife Insults Husband’s Dark Complexion
The Karnataka High Court recently ruled that a wife insulting her husband over his dark complexion, distancing herself from him for the same reason, and making false allegations of an affair amounts to cruelty. The court granted the husband’s appeal for divorce and overturned the family court’s earlier decision to deny it.
Background of the Case
The couple got married in 2007 and had a daughter. In 2012, the husband approached a family court in Bengaluru, seeking a divorce. He claimed that his wife repeatedly humiliated him because of his dark skin. Additionally, in 2011, she filed a false complaint against him and his family under Section 498A of the Indian Penal Code, alleging cruelty. Eventually, she left him to stay with her parents.
The wife, however, denied the allegations and instead accused her husband of having an affair. She further alleged that he assaulted her and that his family mistreated her.
Court’s Observations and Ruling
The High Court found no evidence to support the wife’s claim that her husband was in an illicit relationship or had a child with another woman. The birth certificate produced in court did not confirm such a claim.
Furthermore, the court noted that the wife, during her cross-examination, agreed to live with her husband but refused to withdraw her complaints against him. This, the court stated, demonstrated that she was not willing to reconcile.
Final Verdict
Considering the false allegations and the repeated humiliation based on skin color, the court ruled that the wife’s actions amounted to cruelty. It stated that the family court had failed to recognize the mental distress caused to the husband.
As a result, the High Court allowed the husband’s petition, declaring that his claims of cruelty were valid and granting him a divorce.
This case highlights how baseless accusations and emotional mistreatment can be grounds for divorce under the law.
