Husband and Wife Should Live Together with Mutual Understanding: MP High Court

Madhya Pradesh: The Madhya Pradesh High Court recently highlighted the importance of mutual understanding in marriage, stating that a husband and wife are expected to live together with a spirit of adjustment and cooperation.

The bench, consisting of Justice Rohit Arya and Justice Milind Ramesh Phadke, made this observation while hearing a case involving a wife’s appeal against a court order that had granted her husband a decree for Restitution of Conjugal Rights (RCR).

The couple got married in April 2015 but started living separately just a few days later, in May 2015. In May 2018, the husband approached the First Additional District Judge in Dabra, Gwalior, seeking restitution of conjugal rights under Section 9 of the Hindu Marriage Act, 1955. The court found his intentions genuine and passed a decree in his favor.

The wife later challenged the decree in the High Court. However, during the hearing, she told the court she now wished to live with her husband and no longer wanted to pursue the appeal. The husband also assured the court that he would take full care of her, provide respect, and maintain a peaceful life together within his means.

The High Court appreciated the husband’s respectful attitude and upheld the original decision made by the lower court, allowing the couple an opportunity to rebuild their relationship.

The judgment was delivered in the case titled DIMPLE @ RANI RAWAT v. ASHOK RAWAT [FIRST APPEAL No. 728 of 2021].
