MP High Court: Husband Must Provide Salary Slip in Maintenance Case

Recently, the MP High Court ruled that requiring a husband to produce his salary slip in a maintenance case does not violate his life, liberty, or privacy.

Justice GS Ahluwalia stated that such an order is not a breach of the husband’s privacy. In this case, the Family Court in Gwalior had directed the husband to pay Rs 18,000 monthly as maintenance to his wife and children. However, the husband allegedly tried to delay the matter.

During the appeal, the High Court asked the husband to file a reply detailing his salary. The husband responded but did not include his salary details, arguing it would violate his protection under Article 21 of the Indian Constitution. He also cited Article 20, contending that one cannot be compelled to give evidence against oneself.

The court dismissed this argument, noting that the case involves proceedings under Section 125 of the CrPC, where there’s no risk of conviction. The court referenced various judgments to support the view that disclosing financial details like salary in relevant cases does not violate privacy.

The court warned that failure to produce the salary slip could result in an adverse inference against the husband. The case was scheduled for final hearing on June 20, 2022.
