The Madhya Pradesh High Court recently dismissed a husband’s appeal for divorce, stating that he cannot abandon his responsibilities as a father and husband simply because he wants to serve his parents for the rest of his life.
The appellant had filed for divorce under Section 13 of the Hindu Marriage Act, but the Family Court rejected his application. The court found that the couple’s disputes were minor and did not amount to cruelty, making the husband ineligible for divorce.
Unhappy with the Family Court’s decision, the husband appealed to the MP High Court. Justices Vivek Rusia and AN Kesharwani emphasized that, according to Hindu Law, marriage is a sacred and unbreakable bond. The court noted that marriage is not only considered sacred but also a holy union.
The court ruled that the husband’s desire to serve his parents did not justify abandoning his marital responsibilities. Therefore, the appeal for divorce was dismissed.
