Punjab & Haryana High Court Quashes Rape FIR Against Man Proven to Be Abroad

Chandigarh: The Punjab and Haryana High Court has quashed a rape FIR filed against a man after it was confirmed that he was not in India on the date of the alleged crime.

The case was heard by Justice Jagmohan Bansal, who noted that according to the Investigating Officer, the accused was in London on the night of February 1-2, 2019, when the alleged gang rape supposedly happened.

The accused, Varinder Kumar @ Vicky, had submitted documents showing he left India on January 26, 2019, making it impossible for him to be involved in the incident. The court found this to be a case of blackmail and misuse of the legal process.

The judge remarked:

“It is unfortunate that a woman has made such a serious allegation against a man who wasn’t even in the country. These types of false accusations make it hard to identify genuine cases.”

The court also noted that the prosecutrix (the woman) had turned hostile in relation to three other co-accused, further raising doubts about her intentions.

The court strongly criticized such false allegations, saying they waste judicial time and harm real victims by making it difficult to distinguish between real and fake cases.

Given the clear evidence that the accused was abroad during the time of the alleged rape, the court quashed the FIR, declaring the case baseless.
