In a recent judgment, the Gujarat High Court directed a woman to pay ₹10,000 to her husband after she deserted him due to differences in their sub-castes, despite belonging to the same Patel community.
The case began when the husband filed a Habeas Corpus petition, claiming that his wife was being held against her will by her parents. The court summoned the wife, who confirmed her marriage to the petitioner but expressed her unwillingness to continue the relationship. She cited sub-caste differences as the reason for leaving her husband after four years of marriage.
The court expressed disappointment over the persistence of caste and sub-caste prejudices, calling it unfortunate that such outdated attitudes have ruined the lives of young individuals. The bench acknowledged the petitioner’s emotional distress and dreams shattered by his wife’s decision.
As a result, the court ordered the wife to pay ₹10,000 to her husband as compensation, deeming her reasons for desertion unreasonable and unsupported. The payment must be made within four weeks.
In a prior hearing, the court criticized elders who negatively influence younger generations, stating that their actions often harm rather than guide. The court called for a more responsible approach to fostering harmony in families and society.
With this decision, the petition was closed.
