Delhi Court Orders FIR Against Woman and Father for False Rape Allegations

A Delhi court has ordered the registration of an FIR against a woman and her father for falsely accusing her husband and in-laws of gang rape, cruelty, and wrongful confinement. The decision came after the court found that the prosecution had failed to prove the allegations made against the accused.

False Charges and Court Ruling

The case dates back to 2014, when the woman’s father filed an FIR, claiming that her husband, father-in-law, and sister-in-law demanded dowry and physically abused her. The woman further alleged that her father-in-law and sister-in-law had gang-raped her.

However, after a detailed trial, the court found no evidence to support these claims. Additional Sessions Judge Aanchal stated that while rape is a serious crime, false allegations cause humiliation to the accused and harm their reputation in society.

On May 9, the court acquitted the husband, who was charged under multiple IPC sections, including cruelty (Section 498A), wrongful confinement (Section 342), and criminal breach of trust (Section 406). The father-in-law and sister-in-law were also cleared of gang rape charges (Section 376D).

FIR Ordered Against the Woman and Her Father

The court directed the SHO of Janakpuri Police Station to register an FIR under Section 211 of IPC (false charge with intent to injure) against the woman and her father within 24 hours of receiving the judgment. The police were also instructed to submit a detailed investigation report within three months.

The judge criticized the woman and her father, noting that both had a legal background—the woman being a law graduate and her father an advocate—but still misused the legal system. The court stated that their actions went beyond exaggeration and constituted a serious offense punishable with life imprisonment.

This case highlights the importance of protecting genuine victims of crime while ensuring that false accusations do not harm innocent people.
