The Punjab and Haryana High Court has granted a divorce to a man, citing cruelty from his wife, who filed false cases against him. The court also ordered the husband to pay Rs. 18 lakhs as alimony to his wife.
The husband initially filed a petition under Section 13 of the Hindu Marriage Act, 1955, seeking a divorce on grounds of cruelty and desertion. The family court rejected his petition in May 2017, but he appealed the decision in the High Court.
The case was reviewed by Justices Ritu Bahri and Nidhi Gupta. The husband argued that he married his wife in November 2012, and they lived together for only nine months. He accused his wife of being disrespectful and frequently quarrelsome. He claimed she left him in September 2013, taking her dowry items, and did not return.
The husband also accused his wife of filing numerous false complaints against him and his family, including a complaint with the Army Wives Welfare Association. The wife, on the other hand, denied the allegations and claimed that her husband had tortured her, demanded dowry, and physically abused her.
The court found that the wife made serious but unsubstantiated allegations against her husband and his family, including claims of inappropriate behavior by her father-in-law. After reviewing the evidence, the court concluded that there were irreconcilable differences between the couple, who had been living separately since 2013.
The court granted the divorce, stating that the marriage was now “a mere legal fiction.” In addition to the Rs. 18 lakh alimony, the court noted that the husband had already paid Rs. 23 lakhs in maintenance during the legal proceedings.
