Allahabad High Court Grants Father Visitation Rights to Meet His Son
The Allahabad High Court recently allowed a father’s Habeas Corpus petition, granting him visitation rights to meet his son, who currently lives with his mother.
The child lives with his mother due to a mutual agreement reached during the parents’ divorce. The agreement specified that the child would stay with his mother, but the father filed a complaint, stating he was not allowed to see his child.
Justice Anil Kumar Ojha ruled that since the child was born to petitioner Abhinay Jain and Respondent No. 2, Smt. Megha Jain, the petitioner, as the child’s father, is entitled to visitation rights.
Considering the case’s details, the court granted the father the following visitation rights:
- The father can visit his son once a month, on the first Sunday of the month, from 11:00 a.m. to 1:00 p.m., at the mother’s home.
- The father can also visit his son on the day before Holi and Diwali for two hours at the mother’s residence.
- Both parents must ensure there are no disturbances at the mother’s residence during these visits.
This ruling ensures the father’s right to maintain a relationship with his son while respecting the child’s living arrangements with the mother.
