Father Spends 3 Years in Jail on Daughter’s False Rape Charge, Later Acquitted by Court
A man spent more than three years in jail after being falsely accused of rape by his daughter. The case, which began in August 2017, ended in February 2021 when a special court in Ghaziabad found that the accusation was false.
The FIR was filed at Modinagar police station by the girl’s maternal uncle, not the girl herself. Based on his complaint, the police arrested the father and booked him under several sections of the Indian Penal Code (IPC) and the POCSO Act. He was then sent to jail, where he remained for over three years while the case continued.
During the court trial, the daughter told the special POCSO judge Mahendra Srivastava that she was pressured by her uncle to lie about her father. She admitted in court that the rape claim was false and said she only made the accusation because her uncle forced her to.
Special public prosecutor Utkarsh Vats confirmed that the girl had been living with her maternal uncle and falsely accused her father under his pressure.
The judge immediately acquitted the father and ordered the release of the man, who had already spent more than three years in jail for a crime he didn’t commit.
On February 12, 2021, the court also punished the uncle for provoking the girl to file the false rape case. He was sentenced to one month of simple imprisonment and fined ₹50,000. Out of this fine, the court directed that 50% be paid to the father as compensation for his suffering.
This case highlights the severe consequences of false accusations and the importance of fair legal investigations.
