Kerala High Court: Family Courts Must Set a Time Frame for Case Disposal
The Kerala High Court has ruled that when a request for a time-bound disposal of a case is made, the family court cannot simply state that the case “will be disposed of at the earliest.” Instead, the court must specify a clear time limit in its order.

A division bench of Justice Anil K. Narendran and Justice P.G. Ajithkumar made this ruling while hearing a divorce case. The court emphasized that:
- If a party provides a valid reason for early disposal, the family court must specify a time limit in its order.
- If no justifiable reason is given, the court must reject the request with a brief explanation.
Background of the Case
- The petitioner-wife filed for divorce under Section 13(1)(i)(a) of the Hindu Marriage Act, 1955, in 2018.
- In 2022, she requested a time-bound disposal of the case.
- The family court approved the request but only stated that the case would be disposed of at the earliest—without setting a specific deadline.

The Kerala High Court referred to the case Shiju Joy v. Nisha [2021 (2) KLT 607], which set strict norms for family courts to ensure timely justice.
The court ruled that simply stating a case will be resolved “at the earliest” does not comply with legal standards. The original petition was pending since 2018, and despite repeated hearings, the case had not been resolved.
