Woman Sent to Judicial Custody for Filing False Rape FIR in Hailakandi

In a significant judgment on July 15, the Additional Sessions Judge in Hailakandi, Assam, ordered judicial custody for a woman who filed a false rape case.

The woman has been charged under Sections 193 and 195 of the Indian Penal Code (IPC) for giving false evidence and making a false declaration in court.

The FIR initially accused a man of rape, leading to charges under Sections 448 and 376 of the IPC. However, during the court proceedings, it was found that the allegations were fabricated. The accused claimed that the woman lodged the false complaint due to a land dispute.

The court emphasized the seriousness of rape allegations, noting that such accusations often lead to widespread outrage and demand for strict punishment. However, it also highlighted the detrimental effects of false cases, stating, “False accusations can ruin lives. The judicial system exists to protect justice, not to be misused for personal grudges.”

The judgment further stressed the importance of preventing abuse of the legal system. “The court and police must not be tools for oppression. Those who misuse the law should face consequences to deter others from similar actions,” the court added.

Hailakandi police welcomed the decision, describing it as a strong warning to anyone misusing the judicial and law enforcement systems for personal gains. “This judgment sends a clear message against false allegations that waste the resources of the criminal justice system,” they stated.
