Delhi Court Orders FIR Against Woman and Her Father for False Rape Allegations

Delhi Court Orders FIR Against Woman and Father for Filing False Gangrape Charges

In a significant judgment, a Delhi court has directed the police to register an FIR against a woman and her father for falsely accusing her husband and his family members of gangrape, cruelty, and wrongful confinement.

The case dates back to 2014, when the woman’s father filed a complaint alleging that the woman’s husband, father-in-law, and sister-in-law demanded dowry, and physically abused her. Later, the woman also accused her father-in-law and sister-in-law of gangrape.

However, during the trial, the court found that no solid evidence was presented to support these claims. Additional Sessions Judge Aanchal stated that while rape is a serious crime, false allegations are equally dangerous and cause irreparable harm to the accused and their families.

On May 9, the court acquitted the husband, who was charged under multiple sections of the Indian Penal Code including 498A (cruelty), 342 (wrongful confinement), 323 (voluntarily causing hurt), 406 (criminal breach of trust), and 506 (criminal intimidation). His father and sister were also acquitted of gangrape charges under Section 376D IPC.

The court criticized the woman and her father for misusing the legal system, especially given their legal background—the woman being a law graduate and her father an advocate.

“They took advantage of the system that usually gives strong weight to the woman’s testimony,” the judge remarked.
“Their actions go beyond exaggeration and qualify as deliberate false accusations.”

The Station House Officer (SHO) of Janakpuri Police Station has been instructed to file an FIR under IPC Section 211 (false charge of an offence with intent to harm) against the woman and her father within 24 hours of receiving the order. The court also directed the police to submit an investigation report within three months to the Metropolitan Magistrate.

This judgment serves as a strong warning against the misuse of legal provisions, especially in sensitive matters like rape and domestic violence, and emphasizes the importance of truthful testimony in the justice system.
