Father Jailed for 3 Years Over False Rape Allegation Acquitted

Father Acquitted After 3 Years in Jail for Daughter’s False Rape Allegation

In February 2021, a man who spent over three years in jail was acquitted by a special court in Ghaziabad after his daughter confessed that she falsely accused him of rape under pressure from her maternal uncle. The case was originally filed in August 2017 when the girl’s uncle lodged a complaint at Modinagar police station.

Following the complaint, the father was arrested under various sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. He was placed in judicial custody, and the case was heard in the court of special judge Mahendra Srivastava.

During the trial, the girl admitted she had falsely implicated her father at her uncle’s insistence. The court acquitted the father and imposed a fine of Rs 50,000 on the uncle for provoking the girl to file the false case. Additionally, the uncle was sentenced to one month of simple imprisonment.

The court directed that 50% of the fine amount be paid to the father as compensation for his wrongful imprisonment.
