False Cases Against Husbands Can Ruin Social Fabric, Says Delhi High Court

New Delhi — The Delhi High Court has stated that strict action must be taken in cases where false criminal complaints are filed against husbands and their families. Such actions, if allowed to continue, can seriously damage the legal system and the social fabric of society.

This observation came during a case involving a false report of a woman’s suicide. A complaint was filed under the Dowry Prohibition Act, alleging cruelty, abduction, and an attempt to murder against the husband and his family. However, it was later discovered that the woman was actually alive.

Following this, the husband’s mother filed a counter-FIR, claiming that the woman, along with her family, had staged her disappearance to extort money from the in-laws. A case of cheating and conspiracy was then registered against the woman’s family.

The woman’s brother later approached the Delhi High Court for anticipatory bail. However, the court rejected the plea due to the seriousness of the allegations, noting that the case was a deliberate abuse of the law.

Justice Anoop Kumar Mendiratta remarked, “Criminal law was used as a weapon rather than a shield. The false suicide claim led to the husband’s unjust detention and destroyed any chance of reconciliation.”

The court highlighted the danger of using false allegations during matrimonial disputes. “Allowing such misuse can lead to serious consequences and erode trust in the justice system,” the judge added.

It was also noted that the woman remained in contact with her family during her supposed disappearance, and the matter was exaggerated in the media based on a fake suicide note.

The court’s ruling serves as a reminder of the consequences of misusing legal provisions meant to protect genuine victims.
