Delhi High Court Upholds Divorce Decree: False Allegations of Extra-Marital Affairs Deemed Cruelty
The Delhi High Court has upheld a Family Court’s decision to grant a divorce to a husband, dismissing the wife’s appeal. The court ruled that false accusations of extra-marital relationships are a severe assault on the character and health of the spouse being accused.
The wife had challenged a Family Court judgment from January 31, 2019, which granted the husband a divorce under section 13(1)(a) of the Hindu Marriage Act, 1955. A division bench, including Acting Chief Justice Vipin Sanghi and Justice Dinesh Kumar Sharma, stated that false allegations of extra-marital affairs cause immense mental pain and suffering, amounting to cruelty.
The Court emphasized that the Family Court had correctly evaluated the evidence. The wife had made baseless allegations, amounting to character assassination against her husband and his father, which inflicted mental cruelty on the husband.
The couple married on June 29, 2014, but their relationship soured soon after. They have been living separately since June 2016. The wife filed an FIR against her father-in-law under sections 354, 354A, 354B, and 354C of the IPC. The husband filed for divorce on grounds of cruelty on March 8, 2017, and the Family Court granted the divorce after the trial.
During the trial, the wife failed to provide credible evidence to support her accusations. The police case she filed against her father-in-law resulted in acquittal. The court found that her serious allegations were unsubstantiated and her complaint against her father-in-law also ended in acquittal.
The court stated, “These actions by the appellant can be seen as acts of cruelty against the respondent. Marriage is a sacred relationship, and its purity must be maintained for a healthy society. Thus, we find no reason to interfere with the judgment and decree.”
As a result, the court dismissed the wife’s appeal.
