“Unfortunately, there is no provision like the Domestic Violence Act for a husband to proceed against the wife,” lamented the Madras High Court while reinstating a suspended officer who had suffered cruelty and voluntary desertion by his wife.
In this 2021 case, Dr. P Sasikumar was suspended by the director of Animal Husbandry and Veterinary Services in Chennai due to a domestic issue and a complaint from his estranged wife. Justice Vaidyanathan noted that the complaint was lodged just before the judgment in a prolonged divorce case, suggesting it was intended to harass Dr. Sasikumar. The police took action based on the complaint, leading to his suspension.
The complaint was filed four days before the family court granted the divorce, indicating that the wife anticipated the divorce and aimed to cause trouble for the petitioner. The divorce proceedings, initiated in 2015 in a Salem court, concluded with a divorce order in February 2020.
Justice Vaidyanathan ruled that there was no need for the department to suspend Dr. Sasikumar and ordered his reinstatement within 15 days. He emphasized, “As this case is exceptional, the court interferes with the suspension order and directs the department to reinstate the petitioner within 15 days.”
Justice Vaidyanathan also remarked, “Husband and wife must realize that ‘ego’ and ‘intolerance’ are like footwear and should be left outside their home. Otherwise, the children will have to face a miserable life.”
