A Jammu and Kashmir court has imposed a Rs. 10 lakh fine on a woman for misusing the Domestic Violence (DV) Act against her husband. The court found that the woman abused the legal process, leading to significant hardship for her husband.
The court noted that the woman initially filed a petition under the DV Act but later sought to withdraw it. The husband opposed this withdrawal, and the court found the case to be a clear example of “abuse of process of law.” The legal proceedings had been prolonged unnecessarily, dragging the case to the Supreme Court despite its initial stage.
The court emphasized that the DV Act should not be used to harass or evict a spouse from their own home. It stated that such misuse undermines the effectiveness of the DV Act and can damage the institution of marriage.
As a result, the court dismissed the woman’s petition and ordered her to pay Rs. 10 lakh in compensation to her husband. The court also directed that the husband’s rights to the shared household be restored to the state it was in when the petition was first filed. If the woman fails to pay the fine within one month, the amount will be recovered as land revenue.
