In a recent case from Pune, a man was granted a divorce without having to pay alimony after his wife ignored a court order. The court had previously instructed the couple to live together for a month, but the wife did not follow this order. As a result, the Joint Civil Judge, AP Girdkar, ruled in favor of the husband’s petition for divorce without alimony.
The couple got married in 2009. The husband works a job, while the wife is a homemaker. Just four months into the marriage, the wife left but continued to visit occasionally over the next four years. After 2013, she stopped coming back altogether.
In 2015, the husband sent her a notice, but she did not respond. Eventually, through his lawyer, Adv. Shivajirao Deshmukh, the husband filed a petition in court. The court ordered the wife to return and live with her husband, but she ignored the court summons. In June 2018, the court gave her one month to return and continue the marriage, yet she still did not comply.
Finally, on January 18, 2020, the husband filed for divorce with the assistance of Adv. Shivajirao Deshmukh and Adv. Sai Deshmukh. Despite this, the wife did not appear in court on the assigned dates. The COVID-19 pandemic caused delays in court proceedings, but once restrictions were lifted, the court granted the divorce. The judgment stated that the husband would not have to pay alimony since the wife failed to follow the court’s order.
