MP High Court Refuses Bail to Disabled Man Accused of Rape Due to Caste-Based Rejection
The Madhya Pradesh High Court recently denied bail to a differently-abled man accused of raping a woman on the pretext of marriage, later refusing to marry her due to caste differences.
Justice Vivek Agarwal heard that the accused’s father opposed the marriage due to a 5-year age gap and the different caste of the woman. The judge remarked that it is concerning that social divisions based on caste still exist in today’s society.
This was the accused’s second bail request. He claimed that the woman consented to the relationship, and they even stayed together in hotels multiple times. However, the prosecution argued that both individuals were differently-abled, and the woman was lured with a false promise of marriage.
Once the accused secured a job in the Defence Ministry, he refused to marry the woman, which led to the current case.
The Court pointed out that the accused was fully aware of the caste and age differences at the time of the relationship. Taking into account that the woman is a vulnerable witness, the Court decided this was not the right stage to grant bail.
“To protect the interests of justice and safeguard the rights of a vulnerable witness, bail cannot be granted at this point,” the Court ruled.
