A Delhi court recently acquitted a man accused of rape after reviewing WhatsApp chats that directly contradicted the woman’s claims. The court said that the intimate and friendly nature of the chats made it hard to believe the allegation of forced sexual intercourse.
The woman had alleged that she was raped in a car parked near Sarojini Nagar Market by a man she had a past consensual relationship with. However, the court found that their WhatsApp messages painted a completely different picture—one of mutual affection and personal intimacy.
One important message sent by the woman immediately after the alleged incident said, “kuch mat sochna” (don’t think anything wrong), which the court noted was unlikely if the event had been non-consensual.
The court stated that having forcible sex in a public car park without anyone noticing seemed unrealistic. It further pointed out that the woman filed the FIR nearly five months later, which weakened her case.
The judge observed that the woman is educated and mature, making it unlikely that she stayed silent solely due to a promise of marriage from the accused. Her family was also already searching for other marriage proposals at the time.
The defense lawyer argued that the couple had been in a consensual relationship and that the FIR was filed only to pressure the man into marrying her. The court agreed, saying that the WhatsApp evidence strongly undermined her verbal statements and found no prima facie case to proceed with the charges.
As a result, the court discharged the accused and closed the case.
