Delhi High Court Quashes Rape FIR, Highlights Misuse of Section 376 IPC

The Delhi High Court has recently dismissed a rape FIR against a man, emphasizing the misuse of Section 376 of the Indian Penal Code (IPC). The court stated that this case is a clear example of how innocent individuals face unnecessary hardships due to the wrongful application of this law.

Justice Chandra Dhari Singh remarked, “While Section 376 addresses one of the most serious crimes against women, it is also evident that some people misuse it as a weapon to harass men unfairly.”

The FIR, registered in September 2021, accused the man of sexual harassment. However, he contested the allegations, claiming that he and the complainant were in a consensual relationship. He further argued that the complainant’s statement, recorded before a magistrate, did not accuse him of making false promises of marriage to establish a physical relationship.

To support his claims, the man submitted screenshots of WhatsApp conversations and transcripts of audio recordings. Despite these, the prosecution maintained that the FIR should not be quashed, as it involved a heinous offense under Section 376 IPC.

The court ultimately ruled in favor of the man. It noted that he was willing to marry the complainant despite opposition from his family, but she later entered a relationship with another person. The WhatsApp messages revealed that the complainant had informed the man of her decision to marry someone else, suggesting that the FIR was an afterthought.

The court concluded that the evidence, including WhatsApp chats, audio recordings, and the complainant’s statement under Section 164 of the Criminal Procedure Code (CrPC), clearly indicated a consensual relationship. It determined that the criteria for filing a case under Section 376 IPC were not met.

This decision highlights the importance of safeguarding individuals from false allegations and ensuring that legal provisions are not misused for personal vendettas.
